Pennsylvania Supreme Court Rules that Queer "Hate Crimes" Law Used Against Anti-queer Protestors Violates the Pennsylvania Constitution.
The Pennsylvania Supreme Court announced its ruling Wednesday in Marcavage v. Rendell affirming that the state legislature violated the Pennsylvania Constitution when it added sexual orientation, gender identity and handicapped individuals to Pennsylvania's "ethnic intimidation" law (18 Pa. C.S. § 2710) in 2002.
Foundation for Moral Law (FML) represented seven anti-queer protestors arrested and charged under the "ethnic intimidation" law during a protest at OUTfest 2004. The protestors sued and the Commonwealth Court of Pennsylvania agreed that the law was unconstitutional and struck it down. On appeal the Supreme Court of Pennsylvania agreed with the Commonwealth Court's opinion and the protestors' appellate brief filed by FML.
Judge Roy Moore, chairman of FML, remarked on their case: "We are very happy that the Pennsylvania Supreme Court has ruled in our favor to stop the Governor and a group of corrupt politicians from sneaking a 'hate crimes' bill through the Pennsylvania legislature. Preaching to homosexuals about the sin of sodomy should not be made a 'thought crime' in Pennsylvania or any other state."
In the appellate brief filed March 17, 2008, FML argued to the Pennsylvania Supreme Court that the legislature's altering of an "agricultural crop destruction" bill into an amendment to the "ethnic intimidation" law--making crimes motivated by "sexual orientation," "gender identity" and other classes (handicapped) subject to greater punishment violated, among other provisions, Article III, Section 1 of the Pennsylvania Constitution: "No law shall be passed except by bill, and no bill shall be so altered or amended, on its passage through either House, as to change its original purpose."
The Commonwealth Court agreed that the "ethnic intimidation" amendment violated Section 1 and now so has the Pennsylvania Supreme Court.
Michael Marcavage, director of the anti-queer group Repent America and a petitioner in the case, said: "Having been arrested, jailed and charged with a 'hate crime' for preaching the Gospel, I am elated that the Pennsylvania Supreme Court upheld the lower court's ruling in striking down Pennsylvania's expanded 'hate crimes' law. The methods used by the Pennsylvania legislature in passing the 'hate crimes' bill were extremely devious and yet another chilling example as to how far politicians are willing to go to silence Christian speech that they would violate our own state Constitution to do it."
[Editor's note: It is well past time for the elected officials in PA to correct their error and pass a legitimate hate crimes bill amendment that includes sexual orientation, gender identity, and handicapped individuals. They must also pass an anti-discrimination bill that includes all queers. Time is running out for all incumbents on this matter. If you can not get these measures passed then queer voters should find others who can.]

Marriage Equality: The Battle in California is our Battle

California has fast become the front-line of battle for marriage equality for all Americans as two coalitions wage war over Proposition 8, the California Marriage Protection Action which would alter California's constitution to ban marriage for queer couples.
On one side, we have ProtectMarriage.com, supported by the likes of Focus on the Family, and, on the other, Equality for All, who are fighting against those who oppose the dignity of our love and relationships and are determined to deny us the fundamental freedom, fairness and equality, we have worked so hard to achieve.
Both sides are gearing up for what many observers consider to be the most important marriage equality battle in the nation.
If Proposition 8 is approved by the voters of California, it will be a major set back in the advancement of queer civil rights; it will dramatically slow, if not halt, progress toward full equality for queer Americans.
The significance of this fight should not be underestimated or ignored as evident by the concern of Donald Wildmon, founder of the anti-queer group American Family Association, who told columnist Bill Berkowitz that "If we lose California, if they defeat the marriage amendment, I'm afraid that the culture war is over and Christians have lost. . . I've never said that publicly until now, but that's just the reality of the fact."
"California is a big dam, holding back the flood (in the) culture wars . . . and if you take down the dam in California, it's going to flood 49 other states," he continued.
But beware, these words must not allow us to become complacent! Surely Wildmon words will be used like a bulge calling the troops to rally--dare they lose against the evil foe.
We queers, our families, friends, supporters and allies alike, must stand with our counterparts in California to insure that Proposition 8 is defeated.
Their arguments remain the same; Children need the love of both a father and a mother. The body of research-proof is overwhelming and consistent. Traditional marriage deserves protection because of its contributions to societal well-being. The historic purpose for governmental recognition of marriage has been about children and society. Expanding the definition of marriage by including homosexual relationships adds to the continued disregard for marriage's ultimate purpose. Expanding the definition of marriage begs the question. Why stop at same-sex couples? Legalizing same-sex marriage necessarily mandates changes to all California public-school curriculum. Children will be subjected to a mandatory acceptance of homosexuality and all of its practices.
However, the truth of our nature and the virtue of our humanity dispel these baseless concerns. As it is in our nature to be queer it is also in our nature that we must be giving full and equally citizenship in this country. This includes marriage equality.
I am not concerned that our opponents reject this fundamental truth, but I am concerned that they would impose their false pretense and ideology on us by denying us our rights as Americans.
We must prevent this from happening! Please consider supporting the efforts of Equality for All by any (legal) means available, whether it is a financial donation, or by contacting your friends and family in California to get out and defeat Proposition 8 or email your friends and ask them to get involve and their friends too.
All (queer) Americans have a stake in defeating California Proposition 8, let us rally behind truth and true justice and fight for our full civil rights.

This just in--the second annual Mr. Gay Philadelphia--will also be going Olympic. While all eyes might think that they'll be on Beijing, we'll all be meeting and greeting Bruce Hayes, the first American Olympic gold medalist to "come out of the closet," as a judge on August 8 at UArts' Gershman "Y" Hall, 401 S. Broad Street, Center City Philadelphia
Producers Bruce Yelk, BUCKmoney's James Duggan and yours truly are delighted that Hayes will join fellow queer celebrity judges Michael Musto, Mickey Boardman, Jack Mackenroth, Jesse Archer, and David Moretti who will decide who will be Mr. Gay Philadelphia representing our city at the 2008 North American Mr. Gay contest in Hollywood in October.
Entertaining the audience throughout the evening will be Sirius queer radio talk personality Frank DeCaro as master of ceremonies who will be sharing the stage with local drag personality Brittany Lynn as mistress of ceremonies.
A member of the 1984 United States Olympic Swimming Team, Hayes won a gold medal swimming the anchor leg on the 800 freestyle relay setting a world record. The relay proved to be one of the most memorable moments of the Los Angeles Games, winning the Phillips 66 Performance Award for the best swimming event of the year.
Once Hayes came out publicly as queer, his story received enormous national media coverage. From then, he continued to participate as an athlete at the 1990 Gay Games in Vancouver, Canada, and the 1994 Gay Games in New York City. It was there that he served as the athlete spokesperson for the event, appearing at fundraising events all over the world and in countless media reports.
Hayes has consistently lent his name and support to gay causes, and spoken openly in the mainstream and gay media about his experiences as a gay athlete, breaking down stereotypes and myths that permeate the world of sports.
Not surprisingly, he was included in Out Magazine's list of the 100 most influential gays and lesbians in America in 1994.
Want to be a contestant?
All contestants in the Philadelphia Mr. Gay competition will participate in two rounds of competition - evening wear and swim wear. These rounds will be scored individually by a panel of esteemed celebrity judges and aggregated to select five finalists. These finalists will return to the stage to for a Q&A session conducted by the judges. Following the final round of competition, scores from all three rounds will be aggregated to crown the winner.
The individual entrance fee is $50, and the competition is open to any member of the gay community from the Philadelphia region, southern New Jersey or Delaware.
Philadelphia Mr. Gay will receive free airfare to Los Angeles for the national competition, the champion of which will represent the United States in Mr. Gay International.
And what about giving something back to the community? We do and we are--giving a portion of the proceeds from year's event to benefit two of the city's most outstanding charitable organizations, including ActionAIDS.

Patti Smith, the ultimate iconoclastic artist, told Deborah Solomon (The New York Times Magazine, July 13, 2008) that she doesn't really care for labels, but she doesn't mind being called "the godmother of punk" but she's not trying to create any one image, except being herself: "Seriously, are you trying to cultivate any sort of image, androgynous otherwise? I'm disinterested. I've always looked the same. Since I was a child, I hated having to deal with my hair. I hated having to change my clothes. As a kid, I had a sailor suit and the same old corduroy pants, and that's what I wanted to wear everyday."

During testimony before the House Armed Services Committee hearing on Don't Ask Don't Tell anti-queer crusader Elaine Donnelly, speaking against queers serving I the military, said "we're talking about real consequences for real people," Her written statement included warnings about "inappropriate passive/aggressive actions common in the homosexual community," the prospects of "forcible sodomy" and "exotic forms of sexual expression," and the case of "a group of black lesbians who decided to gang-assault" a fellow soldier.
